Who is covered by HIPAA
The physicians who review and order your test, through [GenieMD Medical Group], and the laboratory that runs it, [Partner Lab], are health care providers covered by the Health Insurance Portability and Accountability Act (HIPAA). Your test order, sample results and medical records are protected health information in their hands, and their Notices of Privacy Practices explain how they use and disclose it: [link to the physician group's Notice of Privacy Practices] and [link to the laboratory's Notice of Privacy Practices].
Newera's role
Newera arranges your order, shipping, payment and customer support. Where we handle protected health information on behalf of the physicians or the laboratory, we do so as their business associate under a written agreement that requires us to protect it [Business Associate Agreement pending]. The rest of the information we handle as a consumer business is covered by our Privacy Policy and Consumer Health Data Privacy Policy.
Your rights under HIPAA
- See and get a copy of your health records, usually within 30 days.
- Ask to correct your records.
- Get a list of certain disclosures of your information.
- Ask the provider to limit how your information is used or shared, or to contact you in a particular way.
- Get a paper copy of a Notice of Privacy Practices.
- File a complaint with the provider, or with the U.S. Department of Health and Human Services Office for Civil Rights, without retaliation.
